Our policy aims to help you better understand what data we collect, why we collect it, and how we use your information. Transparency in our operations is important to us, which is why we want to make the purposes of data collection as clear as possible for our users. At the end of this document, you will find our contact information in case you have any additional questions about our practices.

We adhere to data protection principles in the processing of personal data. The data is collected for a specific, explicit, and/or lawful purpose, and it is not processed in a manner incompatible with those purposes. Personal data is processed lawfully, fairly, and transparently from the data subject’s perspective. The personal data is appropriate, relevant, and necessary for the purposes for which it is processed.

We ensure the security of personal data processing. We employ appropriate technical or organizational measures to protect it. Your data is retained in a form that allows identification of the data subject only for as long as necessary to fulfill the purposes of the data processing.

2. Legal Information

Data security and privacy are at the core of our company values, which is why we prioritize respecting your privacy from the start. In our service, we aim to adhere to privacy principles.

The Mentha App Privacy Policy explains what data we collect about users, how it is collected, and how it is used. We explain the legal basis for each type of data to help you understand why we request it. We also describe the steps we take to protect and ensure your privacy.

3. Data We Collect

We require profile information to deliver our services to you, improve and customize the service, and understand user behavior within the app. We also collect information about your daily mood through a mood survey. To facilitate messaging, we collect the date and time of messages. If you do not consent to this data collection, we cannot provide you with the app’s services.

Users are asked to provide explicit consent before their personal data is collected and used for service purposes (see Section 4: How We Use Your Information). If you withdraw your consent to the use of this data, you will not be able to use our service.

Personal messages are fully end-to-end encrypted, meaning no one else can read them. This includes Mentha Oy, except in cases of reporting (see Data We Receive from Others).

Data You Provide to Us

  • Profile Information: To create an account, you must provide your mobile phone number, date of birth, what languages you can speak and gender. We also ask you to create a PIN code to access the app when it is opened.
  • User Content: The messages you send are fully end-to-end encrypted, meaning that third parties (including Mentha Oy) cannot view the content.
  • Customer Support Information: If you contact customer support, we collect the information you provide during the interaction. We also collect information on how you use customer support services and feedback.
  • Account Login Information: When you register or log in to the service, we verify your account by sending you a code to the phone number you provided. In addition, we ask for a PIN code each time you open the app to ensure you are the rightful owner of the account.

Data Collected Automatically

  • Essential Data for Service Delivery: We automatically collect user data in our system to deliver app services to you and to find the most suitable peer for you. Other users cannot see this data unless you choose to share it with them. Such user data includes mood, app activity, and contact requests.
  • Cookies: A cookie is a text file used to collect information about the use of the website. We collect information with cookies to maintain the website, develop services and web pages, and for marketing purposes. Cookies do not reveal the user’s identity. You can adjust cookies in your browser settings.

Data We Receive from Others

  • User Reports: In the service, you can report other users, and they can report you in the same way. Users can report conversations. For example, messages or discussions may violate our terms of use or policy. When we receive a report, we get information from the reporting user about the user they reported, as well as the user who sent the report. We receive the last twenty messages from the conversation to investigate and/or analyze the situation. Additionally, we receive the user IDs.

4. How We Use Your Information

The company must have a legal basis for collecting and processing data. This section describes why we process your data and how we handle different types of data to achieve each purpose.

  1. Managing Your Account
    • Using Your Phone Number.
      • The service uses your phone number to verify your identity. This ensures that each user account is linked to an active phone number, helping us prevent the creation of fake accounts and reducing spam.
      • If you forget your PIN code, your phone number can be used to recover your account. The service can send a code to the verified phone number, allowing you to restore your account.
      • Asking for your phone number makes it harder for users to create multiple profiles with the same number, which helps to keep the service as a safer environment.
      • Other users cannot see your phone number.
    • We verify your account by sending you a verification code via SMS to the phone number you provided. The verification code ensures that the number belongs to the user attempting to log in.
      • During login, we check if an account already exists with the same number or if the phone number has been blocked.
    • At the login stage, we ask for your date of birth and gender, which we use to deliver our services. These personal details help us form better connections with service users. Other users cannot see your date of birth or gender.
      • The service is intended only for adults, meaning it is not for users under 18 years old. Therefore, minors are not allowed to create an account in our service. If we suspect or learn that you are underage, we may terminate or block your account.
    • We store the terms and privacy settings you have accepted on your account, as well as possibly blocked users.
    • You can delete your account through the app, at which point we will deactivate your account for 30 days and permanently delete the data after 30 days if you have not logged in to the app during that time. We can also delete your account if your behavior violates the app’s policies or terms. The data controller may have an obligation to process some of your data for longer to comply with legislation or regulatory requirements (see Section 7: Data Deletion and Section 6: Data Retention).
  2. Collecting User Data.
    • We use specific user data to find a suitable peer for you. The user data remains between you and us.
  3. Sending and Receiving Messages.
    • In the app, you can send messages to other users and receive them according to the terms of use. You can also delete a message you have sent, in which case it will be automatically deleted for both conversation parties.
  4. Providing and Maintaining the Service.
    • We collect information for troubleshooting and error removal to analyze log data for resolving crashes and user issues.
    • We collect various data on activity and events to monitor the service’s performance, reliability, and efficiency. This helps us optimize service quality.
    • We collect data related to your activity to analyze, for example, the frequency of app use, internal interactions within the app, and how much the app is used daily.
  5. Service Security and Safety.
    • We verify each account with a verification code and check that user registrations are genuine.
    • We log events and user actions in our service and related possible sequential actions, such as repeated reports and similar complaints about a specific user. This helps us identify suspicious users and potential threats to maintain platform security.
    • We respond to and investigate violations of terms and take action. We may block your account if we learn that you are engaging in behavior that violates the terms or involves illegal activity.
      • We can also report these violations to authorities if needed.
    • We log user reports and other feedback and link events or actions to identify inappropriate behavior in our service to minimize harassment.
  6. Communication About the Service and Customer Support.
    • We send you important messages and notifications related to the service. For example, when we update the terms or policies, we notify you within the necessary limits.
    • We review interactions with customer service to improve service quality.
    • We process user support requests and response when you need our help.
  7. Protecting Your or Others’ Vital Interests
    • If someone’s vital interests are at risk—such as in an emergency—we protect them by sharing information with authorities or other advisors. Such interests include, for example, protecting your or another user’s health or well-being.
    • It is in the company’s interest to protect itself, you, users, and others.
    • We take action if someone’s safety is at risk or in the case of immediate harmful behavior.
  8. Business Information and Analysis.
    • We count users and events for documentation purposes. This helps us, for example, determine how many users are in our service and gather other similar information.
    • We analyze feedback received from users. This helps us better understand how and how much our service is used.
  9. Legal Matters.
    • We can retain and/or share information when seeking legal advice or protecting ourselves in legal proceedings.

5. Your Right to Modify Your Information

You have the right to access, modify, and correct your information. In the service, we only request consent for data that is essential for the functionality of our service. If you want to change your phone number, please contact our customer service team@mentha.app.

6. Data Retention

Primarily, we retain your information for the duration of your service use. We may also retain your information as long as necessary for the purposes defined in the privacy policy or other legitimate purposes. In such cases, retention periods are determined on a case-by-case basis, considering (1) the nature of the data and (2) the basis for collection and processing.

For legal reasons, we may retain your information for longer, including after you have deleted your account. Such situations include:

  • Legal requests or statutory obligations to retain information.
  • Protection of one’s own rights.
  • Questions related to service security, rights, and user protection. For example, we retain data if the information may prevent other users from engaging in harassment or misbehavior. Data retention may also be necessary to recover from a disruption of service or other similar challenges.

 

In addition, we will retain your data for as long as necessary if we are investigating a security breach related to your user account.

7. Data Deletion

When you delete your account, we will remove the information we hold about you (excluding special cases, see section 6. Retention of Your Data). When deleting the account, we will remove you from all conversations and delete your active contact requests. You can delete your account through the app’s settings, in which case we will delete the account at your request. You can also request account deletion by sending an email to team@mentha.app. Please remember to include your phone number in the message to facilitate the account deletion process. After deleting your account, we will deactivate it for 30 days and permanently delete the data after 30 days if you have not logged back into the application during that period. If we need to delete your account due to repeated misuse, violations of terms, inappropriate behavior, or similar reasons, we will remove the data from our system within 30 days, provided the incident did not involve criminal activity or other violations of the law.

8. Transferring Data Outside the European Economic Area

We don’t transfer your information outside the European Economic Area.

9. Updating Policies

We may update our privacy policies when updating the app, as well as in response to changes in legislation and regulations. As a user, you will be notified when we have updated our policies, at which point you can provide your consent within our service.

If you wish to withdraw your consent, you can do so at the same time. This may mean that you will no longer be able to use our services.
