To provide our services through the app, website, and features, we need your consent to our terms of service. You accept these terms by registering and downloading our services. By using our services, you acknowledge that you have understood and accepted our terms and privacy policy. If you do not accept these terms, you will not be able to use our services.

Welcome to use the Mentha Oy services. Mentha Oy (“Mentha”, “Mentha App” and its inflections of “we”) offers you (inflections of “you”) access to our services.

1. Your Access to Mentha App

  • Privacy Principle: We have strived to adhere to strict and strong privacy principles since the inception of our service. As we develop and improve our services, we will update our privacy principles.
  • Communication: We offer the ability to communicate and connect anonymously with other users. However, if you are in danger, an emergency, or a crisis situation, do not hesitate to contact emergency services. Mentha Oy services are not intended for use in dangerous or crisis situations. Mentha Oy is not a healthcare service provider as defined by the Act on the Organisation of Social and Health Care Services (612/2021) and is not responsible for providing health advice.
  • Safety: We protect the safety of our services by taking action if we detect or become aware of misuse of the app, disruptive behavior, or actions that violate our terms. We have the right to remove you if you behave inappropriately or violate our terms or privacy policy. We prohibit misuse of the terms and harmful behavior toward others. We will intervene in situations where we believe we can help and protect ourselves, our community, and our users.
  • Our Service Does Not Replace Professional Help: We believe in the power of peer support and its effectiveness in helping with initial problems. However, it is important to note that peer support and our services should not be used as a replacement for professional help. Mentha Oy does not operate as a private service provider as defined by the Act on the Organisation of Social and Health Care Services (612/2021), and the services offered by the company do not replace professional help.
  • Personal Use: Our services are intended for personal use only. If you wish to advertise or promote our services, please contact team@mentha.app. We are not affiliated with third-party mental health professionals, and the support available in the services is peer support, not a substitute for professional help.
  • Improving Our Service: We analyze how you use our services to continuously develop and improve their functionality.

2. Mentha App Account

  • Registration: When registering on the platform, you must provide your phone number so that we can send you a verification code via SMS. During the login process, you must also provide your date of birth, languages that you can speak and gender and create a PIN code that you will need to enter each time you open the app.
  • Your Responsibility: You are responsible for the contacts and messages you send and liable for your own content. Before sending, make sure you definitely want to share the content. You must use our services in accordance with the terms and policies. By accepting the terms, you understand that the terms may change in the future, and it is your responsibility to ensure you are aware of any changes.
  • Do Not Share Personal Information: Personal information, such as phone numbers, names, addresses, or emails, should not be shared with other users in the services.
  • Account Deletion: We have the right to delete or block you if you violate the policies.
  • Age Limit: The age limit for our services is adulthood, meaning you must be over 18 years old to use the services. If we suspect or learn that you are underage, we may terminate or block your account.

Payments: Our services – website and app – are free to use. However, please note that you are responsible for all carrier data packages, internet fees, and other charges and taxes related to using our services.

3. Privacy

We care about and respect your privacy. We protect your data in accordance with the requirements of data protection legislation (Data Protection Act 5.12.2028/1050). Our privacy policy outlines our data practices. For example, we describe what types of information we receive and collect, how we use and share this information, and the rights you have concerning data processing.

4. Acceptable Use of the Service

If you violate our terms or privacy policy, we have the right to (1) block your access to the services, (2) suspend or terminate your account, and (3) remove your account’s content.

By agreeing to the terms, you agree to adhere to the rules of Mentha App.

  • You will comply with our terms and policies and understand that you are responsible for staying informed about any changes and updates related to them.
  • It is your responsibility to keep your account secure.
  • When logging in, you will not provide false information about yourself, impersonate someone else, or use another person’s phone number.
  • You will not use another user’s account.
  • You will not distribute or send spam through our service.
  • You will not bully, threaten, or harass other users or our services.
  • You will not interfere with our services by uploading viruses or other harmful code into the service; you will not compromise the security of the service.
  • You do not have the right to copy or modify the service’s code or other licensed content unless you have been given explicit written permission to do so.
  • You will not forge or tamper with the service’s data in a way that falsifies its origin.
  • You will not use our services illegally; you will not use the service for discriminatory, criminal, harmful, damaging, false, or defamatory purposes; you will not use the service in a way that could harm its reputation or give a false impression of its intended use.
  • You will not encourage or promote actions that violate these terms.
  • You will not send messages in our services that may offend or disturb others; you will not send messages that encourage self-harm or harm to others; you will not send messages that encourage illegal or criminal activity; you will not send defamatory or false messages; you will not send spam or other content that harms the services.
  • If you notice that another user violates these policies or terms, you will immediately report the user in the app or notify team@mentha.app.
  • We have the right to remove your content if it violates the terms or policies; we have the right to delete your account if your actions violate the terms or policies.

5. Monitoring

We have the right to monitor users, and by using our services, you agree that we can monitor your activity on the platform. However, we cannot guarantee that we monitor all activities that occur in the service. We do not monitor individual conversations, but we reserve the right to take necessary actions if required by law. We are not responsible for the messages or content that users send.

If you encounter questions or messages in discussions that make you uncomfortable, do not respond or interact with the user. You can report the user to the service administrators.

If you are harassed in the service in any way, we ask that you report the harassing user to the service administrators immediately.

Please note that if we become aware of harm or bullying directed at users, other people, or us, our obligation is to report the matter to the appropriate authorities or advisors.

6. Licenses and Rights

We do not own the data you submit in our services.

We own all copyrights, logos, trade secrets, and visual designs. You may not use our intellectual property rights unless we have explicitly given you written permission.

You may use our services as permitted by our terms.

7. Disclaimers

Mentha Oy maintains its services so that registered users can use them within the rules. Mentha Oy strives to ensure that the information provided by the service is accurate and up-to-date. The company will correct any errors brought to its attention. However, Mentha Oy is not responsible for the information submitted by users through the service.

  • We offer services “as is” and “as available.”
  • We do not guarantee that the information we provide is complete.
  • We do not guarantee that the information users provide is accurate, complete, up-to-date, or suitable for your purposes.
  • We are not responsible for the content you, other users, or third parties send or provide in our services.
  • We are not responsible for the intentions of the users you interact with in our services.
  • We do not guarantee that our services will be error-free or that they will always function without disruptions, delays, or shortcomings.
  • We are not obligated to monitor our users.
  • We are not responsible for data loss if it is caused by factors beyond our control.
  • We cannot foresee or predict all potential challenges or technical difficulties.
  • We have the right to modify and update our terms and policies.

8. Limitation of Liability

Mentha Oy, its employees, representatives, or directors are not responsible for indirect, incidental, special, or consequential damages arising from or related to the use of the services. If Mentha Oy has acted with the care expected of a professional service provider, we do not accept responsibility for actions, or events over which we had no reasonable control.

9. Service Availability and Termination

Mentha Oy aims to continuously improve and develop its services. This may include expanding, enhancing, removing, or adding features. We may discontinue our services entirely or partially. Our services may be affected by factors, actions, and events beyond our control.

As a user, you have the right to delete your account at any time through the app’s settings. We also have the right to delete or block your account if your actions violate the law or otherwise conflict with the terms or policies.

We may take various actions if the services are used suspiciously, criminally, or illegally, or if we have reason to believe that you are violating our terms or policies.

10. Dispute Resolution

If you, as a user of the service, have a claim against us arising from these terms of use, our services, or related to them, you may resolve your claim in a competent court located in the company’s domicile in Finland. All disputes will be governed by and interpreted in accordance with Finnish law.

11. Indemnification

By accepting the terms of use, you agree to indemnify Mentha Oy in situations where a claim is made against the company due to your activities on the company’s services.

12. Acceptance of Terms

By using our services, you agree to the terms of this agreement, which we may modify from time to time. If you do not accept all of these terms or practices, you are not entitled to use our services.

13. Other

  • This agreement supersedes all previous agreements or representations.
  • These terms, unless otherwise agreed or stipulated, constitute the agreement between you and us. You provide your renewed consent to any updated terms.
  • The service is not intended for use in any country where it would violate local laws.
  • We strive to continually improve the service and will update the terms and policies accordingly; we will also update the terms and policies if we find them to be inappropriate or inadequate.
  • You may not transfer your rights or obligations to another natural person.
  • Our terms or policies do not prevent us from complying with the law.
  • We reserve the rights that we have not granted to you.
  • We appreciate your feedback and suggestions regarding app development or other services, but you are not obligated to provide them.
  • Mentha App does not offer professional help or consulting services. If you feel that you need or require professional help, it is your responsibility to contact the appropriate advisors, authorities, or medical professionals.

 

By agreeing to these terms, you confirm that you are over 18 years old and have read, understood, and accepted our terms and privacy policy.
